I Have Been Denied Access to My Children – What Should I Do?
If contact has stopped, avoid making the situation worse through angry messages, threats or confrontation.
Instead, consider:
1. Keep records
Keep copies of relevant messages, emails and records of attempted contact.
2. Identify the current arrangement
Establish whether you have an existing court order or only an informal agreement.
3. Consider mediation where appropriate
Mediation may provide a way to try to resolve child arrangements without court proceedings.
4. Get appropriate advice
If there are allegations, safeguarding concerns or domestic abuse issues, consider obtaining advice from a regulated family lawyer.
5. Prepare your evidence
If court proceedings are necessary, organisation and preparation are important.
6. Consider what arrangement you are asking for
Think about the practical arrangements that would work for your children, rather than simply saying that you want "access".
What Can the Family Court Decide?
The Family Court can make orders concerning child arrangements.
Depending on the circumstances, this can include:
- Where a child lives
- Time spent with each parent
- Overnight stays
- Weekends
- School holidays
- Communication
- Other arrangements concerning a child's time with parents
The court's central consideration is the welfare of the child.
The aim is not simply to decide which parent "wins".
The court considers what arrangements are appropriate for the individual child.
